Consumer Protection Inspections

An Officer may visit a commercial business in response to a complaint, or as part of a programmed inspection. On arrival at the business the Investigating Officer will:

• Advise the owner of the business or his/her representative of the reason for the visit.

• On completion of the visit, will advise what actions may be required to be undertaken by the proprietor.

• In the event that unsafe goods are found on sale, the proprietor will be advised immediately; requested to remove the products from sale, and to take such other action as may be necessary to retrieve any associated goods.

• The Investigating Officer may if necessary, utilise formal enforcement powers, including the use of suspension and seizure arrangements, if the circumstances required such action to be taken.

• The proprietor will be kept fully advised, both verbally and by correspondence, of the actions that have been taken and the arrangements that need to be implemented by him/her to minimise the risk of unsafe goods being sold to the general public.

• The proprietor of the business should contact the Chief Environmental Health Officer in the event of a disagreement, or a concern regarding any action of an Investigating Officer.
