What Businesses need to do:-
The vast majority of firms already monitor and control the safety of the products they supply. The Consumer Protection Act provides an additional incentive for businesses to ensure that their products provide the safety that people using them or affected by them are reasonably entitled to expect. The following checklist may help businesses to ensure that they meet their obligations under the law:• Review management procedures to check that all stages of production, including design, manufacture, presentation and marketing, are sufficient to ensure that only safe products reach the customer;
• Check what standards apply and ensure your products meet these requirements.
• If a recognised quality Assurance System is not already in place, consider introducing one.
• Assess whether insurance cover is adequate, including product liability insurance.
• Review all contractual arrangements with suppliers, customers or others with whom the business has relevant contracts.
• Keep adequate records, bearing in mind the working life of the products; the 10 year potential liability for product liability claims, and the possible need to identify suppliers of defective products to the business, in defending a product liability action.
